GoodMorning.com 15 Year Limited Mattress Warranty

GoodMorning.com Inc. (“GoodMorning.com”) covers your Mattress (the “Product”) under a 15 year limited warranty (the “Warranty”). This limited Warranty gives you specific legal rights, and you may also have other rights which vary from province to province or state to state.

1. Who this Warranty extends to

This limited Warranty extends to the original purchaser of a Product who is located in Canada or the United States (the “Customer”). The warranty is only valid in the country where the product was purchased. Customers who buy larger quantities for commercial purposes and who are invoiced separately called “Commercial Customers” are also covered by this Warranty.  

All GoodMorning.com warranties, including any implied warranties, are valid only for the period the Product is owned by the original purchaser of the Product. The “original purchaser,” for this Warranty, is the first purchaser of the Product directly from GoodMorning.com or any other website operated by GoodMorning.com. The GoodMorning.com limited Warranty is non-transferable. 

2. Products covered by this limited Warranty

This limited Warranty extends to Products sold by GoodMorning.com, purchased directly from GoodMorning.com or any other website operated by GoodMorning.com, and located in Canada or the United States. 

Some parts of this limited Warranty also extend to covers sold with Mattresses (“Mattress Covers”). 

The Product is designed to work on a surface that is solid and firm, on a bed base that is structurally capable of supporting the weight of the Product and user(s). 

This Warranty does not cover your Product if you do not use it in a manner compatible with the intended design and intended purpose in the home. Damage to the Product caused by moisture, from improper storage or use, is not covered by this Warranty. 

3. What this limited Warranty covers

This limited Warranty applies to the Product in its original packaging sold to you against the following Defects in material and workmanship, provided the Product is used for its intended purpose:

  • Deterioration causing the Product to have a visible indentation greater than two inches (three inches for commercial and institutional orders) that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or adjustable bed base. Normal wear requires that the Product be continuously supported by a matching foundation or adjustable bed base.
  • Any physical flaw in the Product despite normal usage and proper handling.
  • Any manufacturing defect of the Product.

This limited Warranty does not cover the following:

  • A normal increase in softness of the foam.
  • Comfort preference.
  • Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains; provided, that the defect is caused by such abuse or damage.
  • Damage caused by commercial use, such as in a hotel or store – unless you are a Commercial Customer.
  • Replacement of any non-defective pieces in the GoodMorning.com Product (for example, if you purchase a product with multiple components and only one component is defective, then we will only replace the defective component).
  • Products sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Product is not “new” or of “first quality”, or has previously been purchased or used by another consumer.

In the event of a Defect, GoodMorning.com’s sole and exclusive liability and your sole remedy under this limited Warranty will be, at GoodMorning.com’s option, to provide a repaired or replacement Product, subject to your fulfillment of “Your Responsibilities” below. Replacement products may be provided in a colour or design different from the products you originally purchased.

4. Your responsibilities

In the event of a Defect and to get the benefit of this limited Warranty, we may ask you to return your Product to GoodMorning.com and provide GoodMorning.com with proof of the original date of purchase. You must retain a copy of your receipt as proof of purchase. GoodMorning.com will arrange for shipping back the defective Product. Should any shipping or handling costs be incurred by you for return of the Product, you will not be reimbursed for those costs.

Evidence of a Defect and any claims must be sent to the address set forth at the end of this limited Warranty document. You will be required to provide several photographs of any defect that is the subject of any warranty claim. Photograph requirements will vary depending on the product and the nature of the defect. 

If a replacement is necessary, GoodMorning.com will replace your Product with the same or a similar Product only. You will be required to pay the difference between the original purchase price of the Product and that of a replacement Product, including any additional costs, if an upgraded Product is requested.

GoodMorning.com will repair or replace (as applicable) and ship your new Product or upgraded Product back to you.

Replaced or repaired Products are subject to the same limited Warranty as the original Product. If you obtain a replaced or repaired Product, the warranty term of the replaced or repaired Product begins from the date of purchase of the original Product. If you purchase an upgraded product, a new warranty term will begin upon the purchase of the upgraded Product.

The law label and care label must not be removed from the original Product as this identifies the Product for the purpose of the warranties contained herein. 

This warranty is only valid if you unpacked and expanded your Product within the two weeks following the original date of delivery.

The Product must not be used on floors susceptible to moisture build-up such as concrete, below-grade (basement), or on floors in humid environments. Such inappropriate use can result in mould growth on the bottom of the Product and void your Warranty. The Product is designed for use on firm surfaces, non-spring foundations or adjustable bed bases that are structurally capable of supporting the weight of the Customer’s Product, foundation, and user(s). The Customer must use their Product on a foundation that allows air to circulate beneath it. It is the Customer’s responsibility to maintain an adequate foundation and provide appropriate support for the Product. Substitution or use of an improper foundation or other base upon which the Product is placed may result in damage to the product thereby voiding this Warranty. Customers using a bed frame must ensure it provides sturdy support for both the Product and foundation; including a center support and having at least 5-6 legs for queen, king, and California king, and 4 leg support for twin and full Products. Customers using their Product directly on a slatted bed system must ensure that the slats are a minimum of 2 inches in width, and have gaps between them of no more than 3 inches. Queen, king, and California king platform beds and slat system bed frames used in conjunction with your Product require at least one center support beam. Platform beds and adjustable bases made of wired metal are not acceptable for use with the Product.

Measuring Indentations: GoodMorning.com Inc will require that the Customer provide photos demonstrating the indentation by laying the Product directly on a flat floor, and measuring the vertical distance from a flat and level string pulled tightly across the product and lightly contacting the product on opposite sides, to the lowest point of the indentation using a clearly demarcated measuring device.

5. Disclaimer, limitation on liability

To the extent permissible by applicable law, the Product is provided “AS IS” and this Warranty and any implied warranties are your exclusive warranties and replace all other warranties or conditions, express or implied. Some provinces/states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. 

Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may also have other rights that vary from province/state to province/state and jurisdiction to jurisdiction. 

To the maximum extent permitted by applicable law and except as set forth in this limited Warranty, in no event will GoodMorning.com or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the Product or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if GoodMorning.com has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. GoodMorning.com’s total liability will not exceed the purchase price paid for the Product giving rise to such liability.

Some provinces/states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you. 

6. Arbitration

In the event a dispute arises between you and GoodMorning.com arising out of this limited Warranty, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Arbitration Act of the province of Alberta. 

You must seek arbitration for disputes arising out of this limited Warranty before exercising any rights or seeking any other remedies created by any other regulation or legislation. Arbitration will take place in Edmonton, Alberta.

The arbitration will not be combined with any other proceeding or arbitration against one of the parties. Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitration panel. All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The decision and the arbitrators’ award will be in writing and will include a statement setting forth the reasons for the disposition of any claim. A dissenting decision will also be set forth in writing. The arbitrators’ award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction.

7. Governing law

This limited Mattress Warranty will be governed by the laws of the province of Alberta.

15-Year Juno Mattress Warranty

Valid for mattresses delivered up to November 16, 2022.

GoodMorning.com warrants each Juno mattress against defects in workmanship and materials for a period of 15 years. If, during the warranty period, your mattress is found defective due to faulty workmanship or materials it will be repaired or replaced subject to the details below.

Warranty Highlights

  • Juno is part of, and warrantied by, GoodMorning.com, one of Canada’s largest online-only mattress companies.
  • The warranty period for your Juno mattress begins on the date of purchase and ends 15 years later.
  • Your Juno mattress must be unpacked and expanded no more than two weeks after the date of delivery.
  • If, despite normal usage and proper handling, your Juno mattress forms permanent indentations of more than one and a half inches (two inches for commercial and institutional orders) in the first 5 years or two inches (three inches for commercial and institutional orders) in the final 10 years of the warranty period, it will be replaced, at your option, according to the terms below.
  • Your Juno mattress cover will be repaired or replaced if there is damage to the fabric or zipper due to faulty workmanship or imperfections.
  • Your Juno mattress must be used on a suitable base as specified in this warranty.
  • You will be required to take certain photos and measurements of your Juno mattress and send them to Juno’s customer service team to process a warranty claim.

15 Year Full Replacement Warranty

If your Juno mattress has a defect covered under this warranty we will replace or repair it subject to the conditions of this warranty. Your Juno mattress will be repaired or replaced at no additional cost within the first Five years of usage, and at a cost of 75% of the original purchase price between the Sixth and Fifteenth year. For commercial and institutional orders your Juno mattress will be repaired or replaced at a cost of 50% of the original purchase price within the first Five years of usage, and at a cost of 75% of the original purchase price between the Sixth and Fifteenth year of usage.

Validity

This warranty is valid only to the original purchaser of the product as indicated on the original sales receipt. The law tag must not be removed from original product as this identifies the product for the purpose of the warranties contained herein. This warranty is only valid if you unpacked and expanded your Juno mattress within the two weeks following the original date of delivery.

Juno mattresses must not be used on floors susceptible to moisture build-up such as concrete, below-grade (basement), or on floors in humid environments. Such inappropriate use can result in mold growth on the bottom of the mattress and void your warranty. Juno mattresses are designed for use on firm surfaces, non-spring foundations or adjustable bed bases that are structurally capable of supporting the weight of purchaser’s mattress, foundation, and user(s). The purchaser must use their Juno mattress on a foundation that allows air to circulate beneath it. It is the purchaser’s responsibility to maintain an adequate foundation and provide appropriate support for the mattress. Substitution or use of an improper foundation or other base upon which the mattress is placed may result in damage to the product thereby voiding this warranty. Purchasers using a bed frame must ensure it provides sturdy support for both the mattress and foundation; including a center support and having at least 5-6 legs for queen, king, and California king, and 4 leg support for twin and full mattresses. Purchasers using their mattress directly on a slatted bed system must ensure that the slats are a minimum of 2 inches in width, and have gaps between them of no more than 3 inches. Queen, king, and California king platform beds and slat system bed frames used in conjunction with your Juno mattress require at least one center support beam. Platform beds and adjustable bases made of wired metal are not acceptable for use with Juno mattresses.

Juno’s cover can only be spot cleaned using non-chlorinated agents. Washing the cover outside of these care and cleaning instructions will void the warranty.

This warranty covers the following items during normal wear:

  1. Permanent indentations
    1. Deterioration causing the mattress to have a visible indentation greater than one and a half inch (two inches for commercial and institutional orders) in the first 5 years or 2 inches (three inches for commercial and institutional orders) in the final 10 years of the warranty period that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or adjustable bed base.
  2. Physical flaws
    1. Any physical flaw in the mattress that causes the foam material to split or crack despite normal usage and proper handling (this does not apply to commercial or institutional orders).
    2. Any manufacturing defect in the zipper assembly or fabrics of the mattress cover.

This warranty does not cover:

  1. Improper usage (voids the warranty):
    1. Damage from use with an inadequate foundation and/or frame.
    2. Mold or mildew caused from the use of the mattress on non breathable surface.
    3. Mattress damage due to abuse, misuse or unsanitary treatment beyond reasonable use including, but not limited to, burns, cuts, tears, stains, bodily fluids, or spills.
    4. Washing any part of the cover outside of the cleaning and care instructions explicitly provided within this warranty.
    5. Damage to the cover or zipper due to non-compliance with cleaning instructions and/or improper handling of the cover.
    6. Storing/Keeping the mattress on its side for more than three days; the mattress should be kept/stored always in its normal horizontal position.
  2. Normal increase of softness which can occur during regular use.
  3. Body indentations less than one and a half inches (two inches for commercial and institutional orders) in the first 5 years or 2 inches (three inches for commercial and institutional orders) in the final 10 years of the warranty period.
  4. Complications resulting from use or inability to use product including, but not limited to, allergies, back pain, chiro alignments, and fibromyalgia.
  5. Individual comfort preferences.
  6. Height of bed due to purchaser’s bed frame or headboard.
  7. Sheet fit.
  8. Replacement of an accompanying Juno product where only one piece is defective, unless that accompanying piece is also defective.
  9. As a remedy for aches, pains or other health issues.

Supporting Documentation Required To Process Warranty

  1. Photos
    1. Measuring Indentations: GoodMorning.com Inc will require that the purchaser provide photos demonstrating the indentation by laying the product directly on a flat floor, and measuring the vertical distance from a flat and level string pulled tightly across the product and lightly contacting the product on opposite sides, to the lowest point of the indentation using a clearly demarcated measuring device.
    2. Physical flaws: GoodMorning.com Inc will require several photos of any physical flaws that are the origin of a warranty claim. Photos will vary depending on the physical flaw being reported.

Repairs and Replacements

In the event a warranty claim is filed and a warranty replacement is deemed necessary, purchaser will be required to surrender the original product to GoodMorning.com Inc at the time of replacement.

GoodMorning.com Inc may, at its own option, repair or replace the cover provided on the mattress. In the event that GoodMorning.com Inc replaces the mattress cover, GoodMorning.com Inc will replace it with the current style of cover available for the mattress, which may be of a different color or material than the original cover provided.

The warranties contained herein include the costs of shipping and handling, which are to be borne by GoodMorning.com Inc. Additional shipping charges may apply if the mattress has been moved from the original shipping destination, or if the original shipping destination is in a remote location.

Should this warranty be exercised and your product replaced and/or repaired, the warranty for the replacement product will be extended for the duration of the original GoodMorning.com Inc warranty only.

Our representatives or designated agents shall make the final determination regarding repair or replacement.

Please note: On occasion, minor upgrades may be made to products sold on goodmorning.com that may or may not enhance the product’s performance or advertised benefits. Such upgrades may cause minor differences between the delivered product and the advertised product, but such differences are not considered a valid reason for return.

Miscellaneous

Terms and services related in this warranty shall be the purchaser’s sole and exclusive remedy should the product fail during the time frame stated herein. We make no warrant beyond those terms and conditions stated. PLEASE RETAIN THIS WARRANTY AND YOUR ORIGINAL PROOF OF PURCHASE FOR AT LEAST FIFTEEN (15) YEARS FROM YOUR DATE OF PURCHASE.

GoodMorning.com Inc. (“GoodMorning.com”) covers your Mattress (the “Product”) under a 15-year limited warranty (the “Warranty”). This limited Warranty gives you specific legal rights, and you may also have other rights which vary from province to province, or state to state, or country to country.

1. Who this Warranty extends to

This limited Warranty extends to the original purchaser of a Product who is located in Canada or the United States (the “Customer”). The warranty is only valid in the country where the product was purchased. Customers who buy larger quantities for commercial purposes and who are invoiced separately called “Commercial Customers” are also covered by this Warranty.

All GoodMorning.com warranties, including any implied warranties, are valid only for the period the Product is owned by the original purchaser of the Product. The “original purchaser,” for this Warranty, is the first purchaser of the Product directly from GoodMorning.com or any other website operated by GoodMorning.com. The GoodMorning.com limited Warranty is non-transferable.

2. Products covered by this limited Warranty

This limited Warranty extends to Products sold by GoodMorning.com, purchased directly from GoodMorning.com or any other website operated by GoodMorning.com, and located in Canada or the United States.

Some parts of this limited Warranty also extend to covers sold with Mattresses (“Mattress Covers”).

The Product is designed to work on a surface that is solid and firm, on a bed base that is structurally capable of supporting the weight of the Product and user(s).

This Warranty does not cover your Product if you do not use it in a manner compatible with the intended design and intended purpose in the home. Damage to the Product caused by moisture, from improper storage or use, is not covered by this Warranty.

3. What this limited Warranty covers

This limited Warranty applies to the Product in its original packaging sold to you against the following Defects in material and workmanship, provided the Product is used for its intended purpose:

  • Deterioration causing the Product to have a visible indentation greater than two inches (three inches for commercial and institutional orders) that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or adjustable bed base. Normal wear requires that the Product be continuously supported by a matching foundation or adjustable bed base.
  • Any physical flaw in the Product despite normal usage and proper handling.
  • Any manufacturing defect of the Product.

This limited Warranty does not cover the following:

  • A normal increase in softness of the foam.
  • Comfort preference.
  • Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains; provided, that the defect is caused by such abuse or damage.
  • Damage caused by commercial use, such as in a hotel or store – unless you are a Commercial Customer.
  • Replacement of any non-defective pieces in the GoodMorning.com Product (for example, if you purchase a product with multiple components and only one component is defective, then we will only replace the defective component).
  • Products sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Product is not “new” or of “first quality”, or has previously been purchased or used by another consumer.

In the event of a Defect, GoodMorning.com’s sole and exclusive liability and your sole remedy under this limited Warranty will be, at GoodMorning.com’s option, to provide a repaired or replacement Product, subject to your fulfillment of “Your Responsibilities” below. Replacement products may be provided in a colour or design different from the products you originally purchased. GoodMorning.com shall bear the full cost of the repair or replacement as determined above, between years 1 to 10 of the warranty period. Between years 11 to 15, GoodMorning.com shall bear 75% of the cost of repair or replacement as determined above.

4. Your responsibilities

In the event of a Defect and to get the benefit of this limited Warranty, we may ask you to return your Product to GoodMorning.com and provide GoodMorning.com with proof of the original date of purchase. You must retain a copy of your receipt as proof of purchase. GoodMorning.com will arrange for shipping back the defective Product. Should any unapproved shipping or handling costs be incurred by you for return of the Product, you will not be reimbursed for those costs.

Evidence of a Defect and any claims must be sent to the address set forth at the end of this limited Warranty document. You will be required to provide several photographs of any defect that is the subject of any warranty claim. Photograph requirements will vary depending on the product and the nature of the defect.

If a replacement is necessary, GoodMorning.com will replace your Product with the same or a similar Product only. You will be required to pay the difference between the original purchase price of the Product and that of a replacement Product, including any additional costs, if an upgraded Product is requested.

GoodMorning.com will repair or replace (as applicable) and ship your new Product or upgraded Product back to you.

Replaced or repaired Products are subject to the same limited Warranty as the original Product. If you obtain a replaced or repaired Product, the warranty term of the replaced or repaired Product begins from the date of purchase of the original Product. If you purchase an upgraded product, a new warranty term will begin upon the purchase of the upgraded Product.

The law label and care label must not be removed from the original Product as this identifies the Product for the purpose of the warranties contained herein.

This warranty is only valid if you unpacked and expanded your Product within the two weeks following the original date of delivery.

The Product must not be used on floors susceptible to moisture build-up such as concrete, below-grade (basement), or on floors in humid environments. Such inappropriate use can result in mould growth on the bottom of the Product and void your Warranty. The Product is designed for use on firm surfaces, non-flexing foundations or adjustable bed bases that are structurally capable of supporting the weight of the Customer’s Product, foundation, and user(s). The Customer must use their Product on a foundation that allows air to circulate beneath it. It is the Customer’s responsibility to maintain an adequate foundation and provide appropriate support for the Product. Substitution or use of an improper foundation or other base upon which the Product is placed may result in damage to the product thereby voiding this Warranty. Customers using a bed frame must ensure it provides sturdy support for both the Product and foundation; including a center support and having at least 5-6 legs for queen, king, and California king, and 4 leg support for twin and full Products. Customers using their Product directly on a slatted bed system must ensure that the slats are a minimum of 2 inches in width, and have gaps between them of no more than 3 inches. Queen, king, and California king platform beds and slat system bed frames used in conjunction with your Product require at least one center support beam.

Measuring Indentations: GoodMorning.com Inc will require that the Customer provide photos demonstrating the indentation by laying the Product directly on a flat floor, and measuring the vertical distance from a flat and level string pulled tightly across the product and lightly contacting the product on opposite sides, to the lowest point of the indentation using a clearly demarcated measuring device.

5. Disclaimer, limitation on liability

To the extent permissible by applicable law, the Product is provided “AS IS” and this Warranty and any implied warranties are your exclusive warranties and replace all other warranties or conditions, express or implied. Some provinces/states/jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may also have other rights that vary from province/state to province/state and jurisdiction to jurisdiction.

To the maximum extent permitted by applicable law and except as set forth in this limited Warranty, in no event will GoodMorning.com, including its employees or officers, or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the Product or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if GoodMorning.com has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. 6. Arbitration

In the event a dispute arises between you and GoodMorning.com arising out of this limited Warranty, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Arbitration Act of the province of Alberta.

You must seek arbitration for disputes arising out of this limited Warranty before exercising any rights or seeking any other remedies created by any other regulation or legislation in the courts. Arbitration will take place in Edmonton, Alberta.

The arbitration will not be combined with any other proceeding or arbitration against one of the parties. Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitration panel. All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The decision and the arbitrators’ award will be in writing and will include a statement setting forth the reasons for the disposition of any claim. A dissenting decision will also be set forth in writing. The arbitrators’ award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction.

GoodMorning.com warrants each Douglas mattress against defects in workmanship and materials for a period of 15 years. If, during the warranty period, your mattress is found defective due to faulty workmanship or materials it will be repaired or replaced subject to the details below.

Warranty highlights:

  • The warranty period for your Douglas mattress begins on the date of purchase and ends 15 years later.
  • Your Douglas mattress must be unpacked and expanded no more than two weeks after the date of delivery.
  • If, despite normal usage and proper handling, your Douglas mattress forms permanent indentations of more than 1 inch in the first 10 years or 2″ in the final 5 years of the warranty period, it will be replaced, at your option, according to the terms below.

15-Year replacement warranty:

If your Douglas mattress has a defect covered under this warranty we will replace or repair it subject to the conditions of this warranty. Your Douglas mattress will be repaired or replaced at no additional cost within the first ten years of usage, and at a cost of 75% of the original purchase price between the eleventh and fifteenth year.

Validity:

This warranty is valid only to the original purchaser of the product as indicated on the original sales receipt. The law tag must not be removed from the original product as this identifies the product for the purpose of the warranties contained herein. This warranty is only valid if you unpacked and expanded your Douglas mattress within the two weeks following the original date of delivery.

Purchasers using a bed frame must ensure it provides sturdy support for both the mattress and foundation; including a center support and having at least 5-6 legs for queen, king, and California king, and 4 leg support for twin and full mattresses. Purchasers using their mattress directly on a slatted bed system must ensure that the slats are a minimum of 2 inches in width, and have gaps between them of no more than 3 inches. Queen, king, and California king platform beds and slat system bed frames used in conjunction with your Douglas mattress require at least one center support beam. Platform beds and adjustable bases made of wired metal are not acceptable for use with Douglas mattresses.

This warranty covers the following items during normal wear:

  1. Permanent indentations
    1. Deterioration causing the mattress to have a visible indentation greater than 1 inch in the first 10 years or 2 inches in the final 5 years of the warranty period that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or adjustable bed base.
  2. Physical flaws
    1. Any physical flaw in the mattress that causes the foam material to split or crack despite normal usage, and proper handling.
    2. Any manufacturing defect in the zipper assembly or fabrics of the mattress cover.

This warranty will not apply and shall be considered null and void if the mattress is subjected to abuse or improper care such as, but not limited to:

  1. Improper usage:
    1. Damage from use with an inadequate foundation and/or frame.
    2. Mold or mildew caused from the use of the Douglas mattress on a non-breathable surface.
    3. Mattress damage due to abuse, misuse or unsanitary treatment beyond reasonable use including, but not limited to, burns, cuts, tears, stains, bodily fluids, soiling, spots or spills.
    4. Using a base without a centre support/leg.
    5. Damage resulting from the relocation of the Douglas mattress within or from the original residential address.
    6. Non-compliance of washing instructions and handling for the cover resulting in damage to the cover or zipper.
    7. Washing any part of the cover other than the removable top portion.
    8. Damage resulting from jumping on, folding, or keeping in a standing position the Douglas mattress.

This warranty does not cover:

  1. Normal increase of softness which can occur during regular use.
  2. Body indentations less than 1 inch in the first 10 years or 2 inches in the final 5 years of the warranty period.
  3. Variances in any of the dimensions (Length; Width and Height) of 1 inch or less.
  4. Complications resulting from the use or inability to use product including, but not limited to, allergies, back pain, chiro alignments, and fibromyalgia.
  5. Individual comfort preferences.
  6. Height of bed due to purchaser’s bed frame or headboard.
  7. Bedding height and sheet fit.
  8. Compensation for loss of use.
  9. Transportation charges to and from factory unless specified in this agreement.
  10. Replacement of an accompanying Douglas product where only one item is defective, unless that accompanying item is also defective.
  11. We do not warrant our product as a remedy for aches, pains or other health issues.
  12. We do not warrant our product when used for commercial or institutional purposes.

Repairs and replacements:

In the event that a warranty claim is filed and a warranty replacement is deemed necessary, the purchaser will be required to surrender the original product to GoodMorning.com at the time of replacement.

GoodMorning.com may, at its own option, repair or replace the cover provided on the mattress. In the event that GoodMorning.com replaces the mattress cover, GoodMorning.com will replace it with the current style of cover available for the mattress, which may be of a different color or material than the original cover provided.

The warranties contained herein include the costs of shipping and handling, which are to be borne by GoodMorning.com. Additional shipping charges may apply if the mattress has been moved from the original shipping destination, or if the original shipping destination is in a remote location.

Should this warranty be exercised and your product replaced and/or repaired, the warranty for the replacement product will be extended for the duration of the original Douglas warranty only.

Our representatives or designated agents shall make the final determination regarding repair or replacement.

Miscellaneous:

Terms and services related in this warranty shall be the purchaser’s sole and exclusive remedy should the product fail during the time frame stated herein. We make no warrant beyond those terms and conditions stated.

Your Brunswick mattress will be conditionally repaired or replaced at no cost within the warranty period.
This warranty is conditional and subject to the following:

  1. Your mattress has a defect which is specifically due to faulty workmanship or materials; and,
  2. Guidelines of handling the Brunswick mattress as set in this warranty document are met by the purchaser.

This warranty is valid only to the original purchaser of the product as indicated on the original sales receipt. Such inappropriate use can result in mold growth on the bottom of the mattress and will void your warranty. Brunswick mattresses are designed for use on firm surfaces, non-spring foundations or adjustable bed bases that are structurally capable of supporting the weight of purchaser’s mattress, foundation, and user(s).

The purchaser must use their Brunswick mattress on a foundation that allows air to circulate beneath it. It is the purchaser’s responsibility to maintain an adequate foundation and provide appropriate support for the mattress. Substitution or use of an improper foundation or other bases upon which the mattress is placed may result in premature wear and damage to the product thereby voiding this warranty. Purchasers using a bed frame must ensure it provides sturdy support for both the mattress and foundation ensuring it has a centre support and having at least 5-6 legs. Purchasers using their mattress directly on a slatted bed system must ensure that the slats are a minimum of 2 inches in width, and have gaps between them of no more than 3 inches. Queen, King, and California King platform beds and slat system bed frames used in conjunction with your Brunswick mattress require at least one centre support beam. Platform beds and adjustable bases made of wired metal are not acceptable for use with the Brunswick mattress.

This warranty covers the following items during normal wear:

  1. Permanent indentations:
    1. Deterioration causing the mattress to have visible and permanent indentations greater than 2 inches that is not associated with an indentation or sag which has resulted from the use of an improper or unsupportive foundation.
  2. Physical flaws:
    1. Any physical flaw in the mattress that causes the foam material to split or crack, despite normal usage, and proper handling.

This warranty will not apply and shall be considered null and void if the Mattress is Subjected to abuse or improper care such as, but not limited to:

  1. Damage from use with an inadequate foundation and/or frame.
  2. Mold or mildew caused from use of the Brunswick Mattress on a non-breathable surface.
  3. Mattress damage due to abuse, misuse or unsanitary treatment beyond reasonable use including, but not limited to, burns, cuts, tears, stains, bodily fluids, soiling, spots or spills.
  4. Using a base without a centre support/leg.
  5. Damage resulting from the relocation of the Brunswick mattress within or from the original residential address.
  6. Damage resulting from any cleaning method other than the allowable spot cleaning.

  1. Normal increase of softness which can occur during regular use.
  2. Body indentations less than 2 inches.

Duration

Your new Novosbed mattress is covered by a 15 Year Full Replacement Warranty. For 15 years after you purchase your new Novosbed mattress, when it has a defect covered under the warranty, we will replace or repair it. This includes all parts of the mattress. Your Novosbed mattress will be repaired or replaced at no additional cost within the first ten years of usage, and at a cost of 75% of the original purchase price between the eleventh and fifteenth year. For commercial and institutional orders your Novosbed mattress will be repaired or replaced at a cost of: 25% of the original purchase price within the first five years of usage; at a cost of 50% of the original purchase price between the sixth and tenth year of usage; and at a cost of 75% of the original purchase price between the eleventh and fifteenth year of usage.

Validity

This warranty is valid only to the original purchaser of the product as indicated on the original sales receipt. The law tag must not be removed from original product as this identifies the product for the purpose of the warranties contained herein.

Novosbed mattresses must not be used on floors susceptible to moisture build-up such as concrete, below-grade (basement), or on floors in humid environments. Such inappropriate use can result in mold growth on the bottom of the mattress and void your warranty. Novosbed mattresses are designed for use on firm surfaces, non-spring foundations or adjustable bed bases that are structurally capable of supporting the weight of purchaser’s mattress, foundation, and user(s). The purchaser must use their Novosbed mattress on a foundation that allows air to circulate beneath it. It is the purchaser’s responsibility to maintain an adequate foundation and provide appropriate support for the mattress. Substitution or use of an improper foundation or other base upon which the mattress is placed may result in damage to the product thereby invalidating this warranty. Purchasers using a bed frame must ensure it provides sturdy support for both the mattress and foundation; including a center support and having at least 5-6 legs for queen, king and California king and 4 leg support for twin and full mattresses. Purchasers using their mattress directly on a slatted bed system must ensure that the slats are a minimum of 2 inches in width, and have gaps between them of no more than 3 inches. Queen, king, and California king platform beds and slat system bed frames used in conjunction with your Novosbed mattress require at least one center support beam. Platform beds and adjustable bases made of wired metal are not acceptable for use with Novosbed mattresses.

This warranty covers the following items during normal wear:

  1. Permanent Indentations
    1. Deterioration causing the mattress, to have a visible indentation greater than one inch (two inches for commercial and institutional orders) within the first 10 years of normal usage, and greater than two inches (three inches for commercial and institutional orders) within the following 5 years that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or adjustable bed base.
  2. Physical flaws within the first 10 years
    1. Any physical flaw in the mattress that causes the foam material to split or crack despite normal usage and proper handling as described herein and as outlined in the Frequently Asked Questions section (this doesn’t apply to commercial or institutional orders).
    2. Any manufacturing defect in the zipper assembly or fabrics of the mattress cover.

This warranty does not cover:

  1. Improper usage
    1. Damage from use with an inadequate foundation and/or frame.
    2. Damage caused to the foam, cover, or zipper as a result of use with more than one additional top layer.
    3. Mold or mildew caused from the use of the mattress on non breathable surface.
    4. Mattress or foundation damage due to abuse, misuse or unsanitary treatment beyond reasonable use including, but not limited to, burns, cuts, tears, stains, bodily fluids, or spills.
    5. Washing any part of the cover other than the removable top portion.
    6. Non-compliance of washing instructions and handling for the cover resulting in damage to the cover or zipper.
  2. Normal increase of softness which can occur during regular use.
  3. Body indentations less than one inch (two inches for commercial and institutional orders) within the first 10 years of normal usage, and two inches (three inches for commercial and institutional orders) within the following 5 years.
  4. Complications resulting from use or inability to use product including, but not limited to, allergies, back pain, chiro alignments, and fibromyalgia.
  5. Individual comfort preferences.
  6. Height of bed due to purchaser’s bed frame or headboard.
  7. Sheet fit.
  8. Replacement of an accompanying Novosbed product where only one piece is defective, unless that accompanying piece is also defective.

We do not warrant our product as a remedy for aches, pains or other health issues.

    1. Measuring Indentations: GoodMorning.con Inc. will require that the purchaser provide photos demonstrating the indentation by laying the product directly on a flat floor, and measuring the vertical distance from a flat and level string pulled tightly across the product and lightly contacting the product on opposite sides, to the lowest point of the indentation using a clearly demarcated measuring device.
    2. Physical flaws: GoodMorning.con Inc. will require several photos of any physical flaws that are the origin of a warranty claim. Photos will vary depending on the physical flaw being reported.

Repairs and Replacements

In the event a warranty claim is filed and a warranty replacement is deemed necessary, purchaser will be required to surrender the original product to GoodMorning.con Inc. at the time of replacement.

GoodMorning.con Inc. may, at its own option, repair or replace the cover provided on the mattress. In the event that GoodMorning.con Inc. replaces the mattress cover, GoodMorning.con Inc. will replace it with the current style of cover available for the mattress, which may be of a different color or material than the original cover provided.

The warranties contained herein include the costs of shipping and handling, which are to be borne by GoodMorning.con Inc.. Additional shipping charges may apply if the mattress has been moved from the original shipping destination, or if the original shipping destination is in a remote location.

Should this warranty be exercised and your product replaced and/or repaired, the warranty for the replacement product will be extended for the duration of the original Novosbed warranty only.

Our representatives or designated agents shall make the final determination regarding repair or replacement.

Miscellaneous

The Consumer Product Safety Commission has created the CPSC 16 CFR Part 1633, Standard for the Flammability (Open Flame) of mattress Sets; Final Rule. It is understood that CAN/ULC-S137, Standard Method of Test for Fire Growth of mattresses (Open Flame Test) is parallel with 16 CFR Part 1633. It is understood that Novosbed mattresses have been tested and are compliant with CPSC 16 CFR Part 1633. While Novosbed mattresses are tested with the Novosbed Wood Frame Foundations to ensure flammability requirements are met, they may not be warranted for flammability on an alternate choice in foundation.

Terms and services related in this warranty shall be the purchaser’s sole and exclusive remedy should the product fail during the time frame stated herein. We make no warrant beyond those terms and conditions stated. PLEASE RETAIN THIS WARRANTY AND YOUR ORIGINAL PROOF OF PURCHASE FOR AT LEAST FIFTEEN (15) YEARS FROM YOUR DATE OF PURCHASE.

15-Year Apollo Mattress Warranty

GoodMorning.com Inc warrants each mattress against defects in workmanship and materials for a period of 15 years. If, during the warranty period, your mattress is found defective due to faulty workmanship or materials it will be repaired or replaced subject to the details below.

Warranty Highlights

  • The warranty period for your Apollo™ mattress begins on the date of purchase and ends 15 years later.
  • Your Apollo™ mattress must be unpacked and expanded no more than two weeks after the date of delivery.
  • If, despite normal usage and proper handling, your Apollo™ mattress forms permanent indentations of more than one inch (two inches for commercial and institutional orders) in the first 10 years or two inches (three inches for commercial and institutional orders) in the final 5 years of the warranty period, it will be replaced, at your option, according to the terms below.
  • Your Apollo™ mattress cover will be repaired or replaced if there is damage to the fabric or zipper due to faulty workmanship or imperfections.
  • Your Apollo™ mattress must be used on a suitable base as specified in this warranty.
  • You will be required to take certain photos and measurements of your Apollo™ mattress and send them to GoodMorning.com Inc’ customer service team to process a warranty claim.

 

15 Year Full Replacement Warranty

If your Apollo™ mattress has a defect covered under this warranty we will replace or repair it subject to the conditions of this warranty. Your Apollo™ mattress will be repaired or replaced at no additional cost within the first ten years of usage, and at a cost of 75% of the original purchase price between the eleventh and fifteenth year. For commercial and institutional orders your Apollo™ mattress will be repaired or replaced at a cost of: 25% of the original purchase price within the first five years of usage; at a cost of 50% of the original purchase price between the sixth and tenth year of usage; and at a cost of 75% of the original purchase price between the eleventh and fifteenth year of usage).

10-Year Podium Adjustable Bed Warranty

GoodMorning.com warrants each Podium Adjustable Bed Base against defects in workmanship and materials for a period of 10 years. If, during the warranty period, your product is found defective due to faulty workmanship or materials it will be repaired or replaced subject to the details below.

2-Year Hassle-Free Warranty

Your adjustable base is warranted by the manufacturer against defects in materials or workmanship for a period of two years from the date of purchase to the original Purchaser. During such time, the manufacturer will repair or replace, at no cost to the original Purchaser, any warranted part(s)* found to be defective by the manufacturer, in its sole discretion. This includes all pre-authorized labour and transportation costs incurred with the repair or replacement of any part found to be defective.

5-Year Warranty on Parts

During year 3 through 5 from the original purchase date, the manufacturer will replace any part on the adjustable base found to be defective by the manufacturer, to the original Purchaser. The manufacturer’s liability is limited to the replacement of the defective electrical/mechanical part(s)* ONLY with the Purchaser responsible for all service, installation, and transportation cost of said part(s).

10-Year Limited Warranty

Notwithstanding the above, the manufacturer extends a 10-year warranty on mechanical base parts found to be defective on a limited basis as defined herein. Specifically, the manufacturer warrants that for a full 10 years from the commencement date of this warranty, any defect in the workmanship or the materials used shall be covered. For purposes of this 10-year warranty, it specifically excludes the cover, shroud, platform, legs, actuator lift motors, massage motors, control box, remote controls, power supply, and all power supply cords. The purchaser shall pay 1/5 of the current MSRP of the replacement part, or the entire adjustable base if deemed irreparable at the sole discretion of the manufacturer, multiplied by the number of years after the fifth year from the original purchase date. The manufacturer’s liability shall be limited to the replacement of the defective part(s) ONLY with the purchaser responsible for all service, installation and freight costs for said part. This warranty does not apply to floor models.

Additional Terms & Conditions

This warranty does not include reimbursement/replacement for inconvenience, removal, part(s) installation, bed set up, loss of use, normal wear and tear, shipping or any other costs or expenses not expressly covered in this warranty. In addition, this warranty shall be void in the following circumstances:

  1. Damage resulting from misuse or abuse caused by the Purchaser or any third party.
  2. Damage caused by repairs or parts replacement by an unauthorized person.
  3. Damage caused if the adjustable base has been mishandled (including during shipping), subject to physical abuse or an improper power supply, or by failing to adhere to the Owner’s Manual and this warranty.
  4. Damaged mattresses, foundation cover(s), fabric(s), bedding cables, electrical cords or accessories supplied by dealers or any third party. Contact your dealer for warranty information on these items.
  5. Modification of the adjustable base without prior written consent by the manufacturer.
  6. Costs for unauthorized service calls for the purpose of educating the consumer about the adjustable base or locating proper functioning power outlets.
  7. Damage if the recommended weight restrictions are exceeded.
  8. Damage if used in any environment or a commercial setting which was not intended.
  9. This warranty requires notice to be given to GoodMorning.com Inc. of any claim for repairs or replacement parts.
  10. Damage to foam shroud by improper handling or misuse.
  11. *Parts include the following:
    1. Head/Foot Actuator
    2. Massage Motors and Housing
    3. Control Box
    4. Remote Control
    5. Power Cord, Power Supply, and Input Cord f) Mounting Brackets
    6. Support Struts

OTHER THAN AS EXPRESSLY SET OUT HEREIN, AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER ORAL OR WRITTEN WARRANTIES, REPRESENTATIONS, CONDITIONS OR PROMISES, WHETHER EXPRESS OR IMPLIED, AND WHETHER ARISING BY LAW, STATUTE, COURSE OF DEALING OR USAGE OF TRADE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, QUALITY, DURABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT PERMITTED BY APPLICABLE LAWS, ANY IMPLIED WARRANTIES (IF APPLICABLE) ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE MANUFACTURER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, CONSEQUENTIAL, LIQUIDATED OR SIMILAR DAMAGES, WHETHER OR NOT FORESEEABLE.

To the extent permitted by law, this warranty is not transferable and will automatically terminate if the original purchaser sells or otherwise disposes of the adjustable base.

This warranty gives the Purchaser specific legal rights. Other rights, which vary from jurisdiction to jurisdiction, may exist. In addition, some jurisdictions do not allow (i) the exclusion of certain warranties, (ii) limitations on how long an implied warranty lasts and/or (iii) the exclusion or limitation of certain types of costs and/or damages, so the above limitations may not apply.

This warranty is only valid in Canada. For all other jurisdictions, this Limited Product Warranty is valid only in the jurisdictions where the Products are sold by GoodMorning.com Inc. and is valid to the extent permitted by the applicable laws of such jurisdictions.

Weight Limits

This product is not rated to support weights exceeding 650 pounds (295 kg). This product is not rated to support weights in excess of 650 pounds (295 kg) inclusive of the mattress and bedding. The base will structurally support this weight, provided it is evenly distributed across the bed base. The adjustable base is not designed to support or lift this amount in the head or foot sections alone. Exceeding this weight restriction could damage the bed and/or cause injury and will void the warranty.

Who this Protector Warranty extends to

The GoodMorning.com Protector warranty covers the original purchaser of any GoodMorning.com Mattress Protector who is located in Canada and purchased the Mattress Protector directly from GoodMorning.com or any of GoodMorning.com’s retail websites including Douglas, Logan & Cove, Novosbed, Juno, Brunswick, and Recore. Any warranty, or implied warranty, is only valid for the period of time the Mattress Protector is owned by the original purchaser. The original purchaser, for the purposes of this warranty, will be the individual whose details are associated with the online purchase. Please retain a copy of the receipt which was sent to the email address on record.

Photos and original proof of purchase may be required upon a warranty request in order to identify and assess the warranty issue.

During the two (2) years of this warranty, GoodMorning.com will, at its option, repair or replace the Mattress Protector, and pay any return shipping costs. Any third party shipping expenses will not be reimbursed to the customer. Should such replacement take place, this warranty will cover that replaced product within the original two (2) year period only.

What this Protector Warranty Covers

The Protector Warranty applies to defects due to faulty workmanship or materials, subject to the limitations described in this warranty.

What is Not Covered by The Warranty

  1. Normal wear and tear as a result of washing and intended use.
  2. Comfort preference.
  3. Physical abuse or damage to the Protector, including but not limited to, burns, cuts, tears, liquid damage, or stains; provided, that the defect is caused by such abuse or damage.
  4. Damage caused by commercial use, such as in a hotel or store.
  5. Any Protector sold by resellers who are not authorized retailers.

TO THE EXTENT PERMISSIBLE BY APPLICABLE LAW, THE MATTRESS PROTECTOR IS PROVIDED “AS IS” AND THIS WARRANTY AND ANY IMPLIED WARRANTIES ARE YOUR EXCLUSIVE WARRANTIES AND REPLACE ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. GoodMorning.com Inc. (“GoodMorning.com”) covers your Pillow Protector (the “Product”) under a 2-year limited warranty (the “Warranty”). This limited Warranty gives you specific legal rights, and you may also have other rights which vary from province to province or state to state.

1. Who this Warranty extends to

This limited Warranty extends to the original purchaser of a Product who is located in Canada or the United States (the “Customer”). The warranty is only valid in the country where the product was purchased. Customers who buy larger quantities for commercial purposes and who are invoiced separately called “Commercial Customers” are also covered by this Warranty.  

All GoodMorning.com warranties, including any implied warranties, are valid only for the period the Product is owned by the original purchaser of the Product. The “original purchaser,” for this Warranty, is the first purchaser of the Product directly from GoodMorning.com or any other website operated by GoodMorning.com. The GoodMorning.com limited Warranty is non-transferable. 

2. Products covered by this limited Warranty

This limited Warranty extends to Products sold by GoodMorning.com, purchased directly from GoodMorning.com or any other website operated by GoodMorning.com, and located in Canada or the United States. 

This Warranty does not cover your Product if you do not use it in a manner compatible with the intended design and intended purpose in the home. Damage to the Product caused by moisture, from improper storage or use, is not covered by this Warranty. 

3. What this limited Warranty covers

This limited Warranty applies to the Product in its original packaging sold to you against the following Defects in material and workmanship, provided the Product is used for its intended purpose:

  • Any physical flaw in the Product despite normal usage and proper handling.
  • Any manufacturing defect of the Product.

This limited Warranty does not cover the following:

  • Comfort preference.
  • Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains; provided, that the defect is caused by such abuse or damage.
  • Damage caused by commercial use, such as in a hotel or store – unless you are a Commercial Customer.
  • Replacement of any non-defective pieces in the GoodMorning.com Product (for example, if you purchase a product with multiple components and only one component is defective, then we will only replace the defective component).
  • Products sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Product is not “new” or of “first quality”, or has previously been purchased or used by another consumer.

In the event of a Defect, GoodMorning.com’s sole and exclusive liability and your sole remedy under this limited Warranty will be, at GoodMorning.com’s option, to provide a repaired or replacement Product, subject to your fulfillment of “Your Responsibilities” below. Replacement products may be provided in a colour or design different from the products you originally purchased.

4. Your responsibilities

In the event of a Defect and to get the benefit of this limited Warranty, we may ask you to return your Product to GoodMorning.com and provide GoodMorning.com with proof of the original date of purchase. You must retain a copy of your receipt as proof of purchase. GoodMorning.com will arrange for shipping back the defective Product. Should any shipping or handling costs be incurred by you for return of the Product, you will not be reimbursed for those costs.

Evidence of a Defect and any claims must be sent to the address set forth at the end of this limited Warranty document. You will be required to provide several photographs of any defect that is the subject of any warranty claim. Photograph requirements will vary depending on the product and the nature of the defect. 

If a replacement is necessary, GoodMorning.com will replace your Product with the same or a similar Product only. You will be required to pay the difference between the original purchase price of the Product and that of a replacement Product, including any additional costs, if an upgraded Product is requested.

GoodMorning.com will repair or replace (as applicable) and ship your new Product or upgraded Product back to you.

Replaced or repaired Products are subject to the same limited Warranty as the original Product. If you obtain a replaced or repaired Product, the warranty term of the replaced or repaired Product begins from the date of purchase of the original Product. If you purchase an upgraded product, a new warranty term will begin upon the purchase of the upgraded Product.

The care label must not be removed from the original Product as this identifies the Product for the purpose of the warranties contained herein. 

5. Disclaimer, limitation on liability

To the extent permissible by applicable law, the Product is provided “AS IS” and this Warranty and any implied warranties are your exclusive warranties and replace all other warranties or conditions, express or implied. Some provinces/states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. 

Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may also have other rights that vary from province/state to province/state and jurisdiction to jurisdiction. 

To the maximum extent permitted by applicable law and except as set forth in this limited Warranty, in no event will GoodMorning.com or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the Product or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if GoodMorning.com has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. GoodMorning.com’s total liability will not exceed the purchase price paid for the Product giving rise to such liability.

Some provinces/states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you. 

6. Arbitration

In the event a dispute arises between you and GoodMorning.com arising out of this limited Warranty, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Arbitration Act of the province of Alberta. 

You must seek arbitration for disputes arising out of this limited Warranty before exercising any rights or seeking any other remedies created by any other regulation or legislation. Arbitration will take place in Edmonton, Alberta.

The arbitration will not be combined with any other proceeding or arbitration against one of the parties. Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitration panel. All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The decision and the arbitrators’ award will be in writing and will include a statement setting forth the reasons for the disposition of any claim. A dissenting decision will also be set forth in writing. The arbitrators’ award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction.

7. Governing law

This limited Pillow Protector Warranty will be governed by the laws of the province of Alberta.

Novosbed Foundation

Novosbed 5-Year Foundation Warranty

GoodMorning.com Inc. warrants each Novosbed Foundation for a period of 5 years, prorated against defects in workmanship and materials. If, during the warranty period, your foundation is found defective because of faulty workmanship or structural defects, subject to the details below, it will be replaced or repaired at our expense.

SUMMARY
  • You must use your foundation on an appropriate base
  • You must assemble your foundation properly, as outlined in the instruction manual
  • During a period of 5 years, we will repair or replace, at our expense, your foundation should it be defective
DETAILS

This warranty covers any physical flaw in the foundation that causes it to bend, crack, or permanently deform more than 1 inch. It is incumbent on the consumer to assemble the foundation correctly.

The warranties contained herein include the costs of shipping and handling, which are to be borne by GoodMorning.com Inc. Additional shipping charges may apply if the foundation has been moved from the original shipping destination, or if the original shipping destination is in a remote location.

All warranties contained herein are void if the product is found to have been tampered with or misused by the purchaser beyond reasonable wear, and shall not apply if the product has been physically damaged intentionally or due to accident or neglect; including but not limited to damage by burns, cuts, water, stains, bodily fluids or is otherwise abnormally soiled, used or unsanitary. It is the consumer’s prerogative to protect the foundation appropriately.

These warranties are valid only to the original purchaser of the product as indicated on the original sales invoice. The law tag must not be removed from the original product as this identifies the product for the purpose of the warranties contained herein. The original invoice is required and is the only acceptable proof of purchase.

Should this warranty be exercised and your product replaced and/or repaired, the warranty will not be extended or renewed.

In the event a warranty claim is filed and a warranty replacement is deemed necessary, purchaser will be required to surrender the original product to GoodMorning.com Inc. at the time of replacement.

Terms and services related in this warranty shall be the consumers sole and exclusive remedy should the product fail during the time frame stated herein. We make no warrant beyond those terms and conditions stated. PLEASE RETAIN THIS WARRANTY AND YOUR ORIGINAL PROOF OF PURCHASE FOR AT LEAST FIVE (5) YEARS FROM YOUR DATE OF PURCHASE.

Douglas, Juno, and Logan & Cove Foundations

1-Year Limited Warranty with Lifetime Free Replacement Parts

The Douglas, Juno, and Logan & Cove Foundations are covered by a one (1) year Limited Warranty. For one (1) year after purchase, if your foundation is found to be defective due to faulty workmanship or materials we will offer either a one-time replacement of, or repair to, the foundation, at our expense. Furthermore, will provide lifetime free replacement parts when necessary, subject to the limitations described herein.

This Warranty, including lifetime provision of replacement parts, DOES cover:

  1. Defects due to faulty workmanship or materials.

This Warranty, including lifetime provision of replacement parts, DOES NOT cover:

  1. Damage to the Foundation and/or cover resulting from the use of an improper bed frame, and/or the use of the Foundation on the floor, and/or the use of the Foundation in an unsuitable manner, and/or the incorrect assembly of the Foundation and/or cover;
  2. Intentional, accidental, or negligent physical abuse that causes damage to the Foundation and/or cover;
  3. Damage to the Foundation and/or cover caused by burns, cuts, liquid damage, stains, bodily fluids, abnormal use, unsanitary use, or soiling;
  4. Damage to the Foundation and/or cover incurred by transportation after initial delivery;
  5. Accidental loss of parts following the disassembly of the foundation;
  6. A foundation and/or cover that is sold by an unauthorized retailer, or a product that is in any way sold as “used” or with any other similar wording indicating the product is not “new.”

The Douglas, Juno, and Logan & Cove Foundation 1-Year Limited Warranty with Lifetime Free Replacement Parts covers the original purchaser of any Douglas, Juno, or Logan & Cove Foundation who is located in Canada. Any warranty, or implied warranty, is only valid for the period of time the Foundation is owned by the original purchaser. The original purchaser, for the purposes of this warranty, will be the individual whose details are associated with the online purchase. Please retain a copy of the receipt sent to the email address on record.

All labels on the Foundation must not be removed from the original product as these labels identify the product for the purpose of the warranties contained herein.

During the One (1) year duration of the 1-Year Limited Warranty with Lifetime Free Replacement Parts, GoodMorning.com will, at its option, repair or replace the product, or ship replacement parts. In the event of a repair or replacement, GoodMorning.com will cover the costs of shipping and handling; however, additional shipping charges may apply if the foundation has been moved from the original shipping destination, or if the original shipping destination is in a remote location. Shipping costs of replacement parts are to be paid for by the original purchaser. Any third-party shipping expenses will not be reimbursed to the customer.

In the event that a warranty claim is filed and a warranty replacement is deemed necessary, the customer will be required to surrender the original product to GoodMorning.com at the time of replacement.

GoodMorning.com 2 Year Limited Metal Bed Frame Warranty

GoodMorning.com Inc. (“GoodMorning.com”) covers your Metal Bed Frame (the “Product”) under a 2 year limited warranty (the “Warranty”). This limited Warranty gives you specific legal rights, and you may also have other rights which vary from province to province or state to state.

1. Who this Warranty extends to

This limited Warranty extends to the original purchaser of a Product who is located in Canada or the United States (the “Customer”). The warranty is only valid in the country where the product was purchased. Customers who buy larger quantities for commercial purposes and who are invoiced separately called “Commercial Customers” are also covered by this Warranty.  

All GoodMorning.com warranties, including any implied warranties, are valid only for the period the Product is owned by the original purchaser of the Product. The “original purchaser,” for this Warranty, is the first purchaser of the Product directly from GoodMorning.com or any other website operated by GoodMorning.com. The GoodMorning.com limited Warranty is non-transferable. 

2. Products covered by this limited Warranty

This limited Warranty extends to Products sold by GoodMorning.com, purchased directly from GoodMorning.com or any other website operated by GoodMorning.com, and located in Canada or in the United States. 

This Warranty does not cover your Product if you do not use it in a manner compatible with the intended design and intended purpose in the home. Damage to the Product caused by moisture, from improper storage or use, is not covered by this Warranty.

3. What this limited Warranty covers

This limited Warranty applies to the Product in its original packaging sold to you against the following Defects in material and workmanship, provided the Product is used for its intended purpose:

  • Any physical flaw in the Product despite normal usage and proper handling.
  • Any manufacturing defect of the Product.

This limited Warranty does not cover the following:

  • Comfort preference.
  • Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains; provided, that the defect is caused by such abuse or damage.
  • Damage caused by commercial use, such as in a hotel or store – unless you are a Commercial Customer.
  • Replacement of any non-defective pieces in the GoodMorning.com Product (for example, if you purchase a product with multiple components and only one component is defective, then we will only replace the defective component).
  • Products sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Product is not “new” or of “first quality”, or has previously been purchased or used by another consumer.

In the event of a Defect, GoodMorning.com’s sole and exclusive liability and your sole remedy under this limited Warranty will be, at GoodMorning.com’s option, to provide a repaired or replacement Product, subject to your fulfillment of “Your Responsibilities” below. Replacement products may be provided in a colour or design different from the products you originally purchased.

4. Your responsibilities

In the event of a Defect and to get the benefit of this limited Warranty, we may ask you to return your Product to GoodMorning.com and provide GoodMorning.com with proof of the original date of purchase. You must retain a copy of your receipt as proof of purchase. GoodMorning.com will arrange for shipping back the defective Product. Should any shipping or handling costs be incurred by you for return of the Product, you will not be reimbursed for those costs.

Evidence of a Defect and any claims must be sent to the address set forth at the end of this limited Warranty document. You will be required to provide several photographs of any defect that is the subject of any warranty claim. Photograph requirements will vary depending on the product and the nature of the defect. 

If a replacement is necessary, GoodMorning.com will replace your Product with the same or a similar Product only. You will be required to pay the difference between the original purchase price of the Product and that of a replacement Product, including any additional costs, if an upgraded Product is requested.

GoodMorning.com will repair or replace (as applicable) and ship your new Product or upgraded Product back to you.

Replaced or repaired Products are subject to the same limited Warranty as the original Product. If you obtain a replaced or repaired Product, the warranty term of the replaced or repaired Product begins from the date of purchase of the original Product. If you purchase an upgraded product, a new warranty term will begin upon the purchase of the upgraded Product.

The law label and care label must not be removed from the original Product as this identifies the Product for the purpose of the warranties contained herein.

5. Disclaimer, limitation on liability

To the extent permissible by applicable law, the Product is provided “AS IS” and this Warranty and any implied warranties are your exclusive warranties and replace all other warranties or conditions, express or implied. Some provinces/states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. 

Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may also have other rights that vary from province/state to province/state and jurisdiction to jurisdiction. 

To the maximum extent permitted by applicable law and except as set forth in this limited Warranty, in no event will GoodMorning.com or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the Product or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if GoodMorning.com has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. GoodMorning.com’s total liability will not exceed the purchase price paid for the Product giving rise to such liability.

Some provinces/states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you. 

6. Arbitration

In the event a dispute arises between you and GoodMorning.com arising out of this limited Warranty, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Arbitration Act of the province of Alberta. 

You must seek arbitration for disputes arising out of this limited Warranty before exercising any rights or seeking any other remedies created by any other regulation or legislation. Arbitration will take place in Edmonton, Alberta.

The arbitration will not be combined with any other proceeding or arbitration against one of the parties. Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitration panel. All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The decision and the arbitrators’ award will be in writing and will include a statement setting forth the reasons for the disposition of any claim. A dissenting decision will also be set forth in writing. The arbitrators’ award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction.

7. Governing law

This limited Metal Bed Frame Warranty will be governed by the laws of the province of Alberta.

3. What this limited Warranty covers

This limited Warranty applies to the Product in its original packaging sold to you against the following Defects in material and workmanship, provided the Product is used for its intended purpose:

  • Any physical flaw in the Product despite normal usage and proper handling.
  • Any manufacturing defect of the Product.

This limited Warranty does not cover the following:

  • Comfort preference.
  • Physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains; provided, that the defect is caused by such abuse or damage.
  • Damage caused by commercial use, such as in a hotel or store – unless you are a Commercial Customer.
  • Replacement of any non-defective pieces in the GoodMorning.com Product (for example, if you purchase a product with multiple components and only one component is defective, then we will only replace the defective component).
  • Products sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Product is not “new” or of “first quality”, or has previously been purchased or used by another consumer.

In the event of a Defect, GoodMorning.com’s sole and exclusive liability and your sole remedy under this limited Warranty will be, at GoodMorning.com’s option, to provide a repaired or replacement Product, subject to your fulfillment of “Your Responsibilities” below. Replacement products may be provided in a colour or design different from the products you originally purchased.

4. Your responsibilities

In the event of a Defect and to get the benefit of this limited Warranty, we may ask you to return your Product to GoodMorning.com and provide GoodMorning.com with proof of the original date of purchase. You must retain a copy of your receipt as proof of purchase. GoodMorning.com will arrange for shipping back the defective Product. Should any shipping or handling costs be incurred by you for return of the Product, you will not be reimbursed for those costs.

Evidence of a Defect and any claims must be sent to the address set forth at the end of this limited Warranty document. You will be required to provide several photographs of any defect that is the subject of any warranty claim. Photograph requirements will vary depending on the product and the nature of the defect.

If a replacement is necessary, GoodMorning.com will replace your Product with the same or a similar Product only. You will be required to pay the difference between the original purchase price of the Product and that of a replacement Product, including any additional costs, if an upgraded Product is requested.

GoodMorning.com will repair or replace (as applicable) and ship your new Product or upgraded Product back to you.

Replaced or repaired Products are subject to the same limited Warranty as the original Product. If you obtain a replaced or repaired Product, the warranty term of the replaced or repaired Product begins from the date of purchase of the original Product. If you purchase an upgraded product, a new warranty term will begin upon the purchase of the upgraded Product.

The care label must not be removed from the original Product as this identifies the Product for the purpose of the warranties contained herein.

5. Disclaimer, limitation on liability

To the extent permissible by applicable law, the Product is provided “AS IS” and this Warranty and any implied warranties are your exclusive warranties and replace all other warranties or conditions, express or implied. Some provinces/states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may also have other rights that vary from province/state to province/state and jurisdiction to jurisdiction.

To the maximum extent permitted by applicable law and except as set forth in this limited Warranty, in no event will GoodMorning.com or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the Product or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if GoodMorning.com has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. GoodMorning.com’s total liability will not exceed the purchase price paid for the Product giving rise to such liability.

In the event a dispute arises between you and GoodMorning.com arising out of this limited Warranty, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Arbitration Act of the province of Alberta.

You must seek arbitration for disputes arising out of this limited Warranty before exercising any rights or seeking any other remedies created by any other regulation or legislation. Arbitration will take place in Edmonton, Alberta.

The arbitration will not be combined with any other proceeding or arbitration against one of the parties. Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitration panel. All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The decision and the arbitrators’ award will be in writing and will include a statement setting forth the reasons for the disposition of any claim. A dissenting decision will also be set forth in writing. The arbitrators’ award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction.

7. Governing law

This limited Sheet Set Warranty will be governed by the laws of the province of Alberta.

GoodMorning.com Inc. (“GoodMorning.com”) covers your Weighted Blanket (the “Product”) under a 2-year limited warranty (the “Warranty”). This limited Warranty gives you specific legal rights, and you may also have other rights which vary from province to province or state to state.

1. Who this Warranty extends to

This limited Warranty extends to the original purchaser of a Product who is located in Canada or the United States (the “Customer”). The warranty is only valid in the country where the product was purchased. Customers who buy larger quantities for commercial purposes and who are invoiced separately called “Commercial Customers” are also covered by this Warranty.

All GoodMorning.com warranties, including any implied warranties, are valid only for the period the Product is owned by the original purchaser of the Product. The “original purchaser,” for this Warranty, is the first purchaser of the Product directly from GoodMorning.com or any other website operated by GoodMorning.com. The GoodMorning.com limited Warranty is non-transferable.
